General Policy 2
Requires development to respect site/surroundings in siting/layout/scale, not adversely affect character, amenity, highway safety, or traffic flows. Proposal partially meets via temporary nature, conditions, and low impacts but is contrary overall; approved as exception due to TT need despite visual harm and zoning mismatch.
General Policy 3
Prohibits development outside zoned areas except for overriding national need (g). Directly applied as basis for approval: TT accommodation justified as 'overriding national need' with no reasonable alternative, on unzoned cleared prison site.
Business Policy 11
Requires tourism development to accord with sustainable objectives and countryside protections. Noted but no rural issues; temporary TT tourism accepted despite lack of specific temporary accommodation policy.
Transport Policy 4
Requires highways to accommodate development traffic safely. Satisfied via conditions for visibility splays and parking layout, addressing Highway Services concerns; previous prison use had higher traffic.
Time limit and site restoration
The temporary building/s hereby approved on this site shall not be in situ before the 16th May 2019 and not in operation till the 24th May 2019 and until the 9th June 2019. The site shall be restored to its former condition within 4 days of the temporary building/s being removed after the event.
Highway visibility splays
Prior to the commencement of the development, a plan must be submitted to and approved in writing by the Department to show highway visibility splays of 2.4m x 43m in both directions to the nearside kerb line from the site access to be used as the exit. The visibility splays as approved must be provided prior to first use of the development, and permanently maintained as such unobstructed thereafter with nothing above 1m in height within the visibility splay areas.
Car park layout
Prior to the commencement of the development, a plan must be submitted to and approved in writing by the Department to show the car park laid out with spaces of at least 2.5m x 5m in size with a minimum car park aisle width of 6m. The car park must be marked out in accordance with the approved plan prior to first use of the development.
does not oppose
does not oppose subject to planning conditions on visibility splays, car park layout, and TT-period restriction (DNOC)
Douglas Borough Council has no objections to the application. Highway Services opposes the application due to insufficient information on parking, servicing, and sub-standard visibility splays.
Key concern: Highway visibility of site exit is sub-standard due to front boundary wall height
Douglas Borough Council
No ObjectionDouglas Borough Council has no objections to the listed applications directly below.; It should be noted that the comments are made in relation to the Town and Country Planning Acts and does not imply approval or consent under any other relevant enactment, byelaw, order or regulation.
Highway Services
ObjectionHighway Services opposes the application due to a lack of information as described above.; Visibility splays of 2.4m x 43m should be provided in both directions to the nearside kerb line on a scale plan for the site exit; It may be necessary to mark out the hardstanding area adjacent to the site entrance for parking to maximise the use of it and ensure adequate manoeuvring space
Conditions requested: A planning condition would be needed to restrict the use of the tourist units to the TT period only
