The officer assessed the principle of development as acceptable because the site is within Area 10 zoned for 'proposed predominantly residential use' under the Laxey and Lonan Area Plan 2005, specific…
Residential Policy 1 of Laxey and Lonan Area Plan Order 2005
Requires residential development only in designated proposed/existing residential areas. The site is in Area 10 zoned proposed residential, with paragraph 4.47 supporting infill dwellings, so principle accepted subject to other considerations.
Policy L/S/PR/1
No development permitted unless sewage disposal satisfactory to relevant Departments. Assessed as a Building Control matter despite local plan noting difficulties; no objection raised.
Policy L/S/PR/2
Foul sewage to public sewer where connectable, no discharge to surface water and vice versa. Drainage connections previously approved under PA15/00579/B; treated as Building Control issue.
General Policy 2
Permits development in line with Area Plan zoning if it respects site/surroundings in siting/layout/scale/design/landscaping, does not harm landscape/townscape/amenity/road safety, and provides safe access/parking. Proposal satisfied criteria via compatible design, minimal amenity/highway impacts, and pre-approved access.
Housing Policy 4
New housing primarily in towns/villages or Area Plan urban extensions; countryside only in exceptional cases. Site zoned residential in Area Plan, so acceptable as non-exceptional rural infill.
Housing Policy 6
Residential zoned land per Area Plan brief or para 6.2 criteria, encouraging good design. No specific brief but design traditional/innovative, matching adjacent, in varied streetscene.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Landscaping scheme
No development shall be commenced until a hard and soft landscaping scheme has been submitted to and approved in writing by the Department. Such a scheme shall include details of all walls, fences, trees, hedgerows and other planting which are to be retained; details of all new walls, fences and other boundary treatment and finished ground levels; a planting specification to include; the location of grassed areas details of the hard surface treatment of the open parts of the site and a programme of implementation. All works shall be carried out in accordance with the approved details. The works shall be carried out prior to the occupation of any part of the development or in accordance with the programme agreed in writing with the Department. Any trees or plants indicated on the approved scheme which, within a period of five years from the date of planting, die, are removed or become seriously damaged or diseased shall be replaced during the next planting season with other trees or plants of a species and size to be first approved in writing by the Department. Reason: To ensure the provision of an appropriate landscape setting to the development.
