The original application 10/01277/B for creation of hard standing and vehicular access onto Victoria Road was refused by the Planning Committee on 16 December 2010 for highway safety/free flow of traffic concerns and harm to visual amenities/streetscene from wall alterations. This followed a prior refused application 10/0003/B dismissed at appeal due to defective design. The appellant argued the revised scheme addressed previous highway safety issues, gained Highways Division approval, and existing access from Marathon Road was inadequate. The planning officer recommended approval but the Committee refused. Inspector David Ward held an inquiry on 16 March 2011, found highway concerns unsupported by evidence, noted no continuous wall frontage exists, and concluded no unacceptable harm to streetscene. The Minister accepted the recommendation, allowed the appeal on 19 April 2011 subject to conditions.
