Areas which may be developed for shopping facilities include the former brickworks (Foxdale Local Plan)
Foxdale Local Plan identifies the site as Industrial/Retail and specifically the former brickworks for shopping facilities or mixed light industrial/retail/small-scale commercial to maximise use and improve appearance. Officer assessed the car sales as fitting this flexible zoning.
General Policy 2
Requires development in zoning to respect site/surroundings, not harm landscape/townscape/amenity/highways, provide parking etc. Officer found proposal compliant given screening, no amenity/highways harm, and parking condition; visual impact less than previous use.
Business Policy 1
Encourages employment growth if accords with other policies. Officer noted proposal supports this as it complies with zoning and other Strategic Plan policies.
Business Policy 10
Retail permitted only in town/village centres or designated exceptions. Site designated retail in Foxdale Plan; officer judged car sales retail use acceptable here as advocated for improvement.
Transport Policy 7
Requires parking per standards. No set standard for this retail but Appendix 7 requires customer parking for neighbourhood shops; condition imposed for 5 visitor spaces to prevent highway impact.
Approved plans
This approval relates to the sale and storage of vehicles on land adjacent to the Old Brickworks, Mines Road, Foxdale as shown by the plans and information 1624/1, 1624/2 and Enforcement Photographs ×10 submitted and date stamped 20th August 2008.
Visitor parking spaces
Within 28 days of the decision notice becoming final, a plan must be submitted and approved by the Planning Authority showing 5 dedicated visitor parking spaces. These must be clearly marked as being reserved for customers visiting the site and retained for this use only. It is recommended that the applicant consults with The Department of Transport Highways Division in relation to this issue.
Surface water drainage
There must be NO discharge of surface water (including that from roofs and paved areas) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.
No objections; proposed use represents an improvement over existing use in terms of visual impact; prefer this site over another in Foxdale (Brookfield House); wish to see proper forecourt established
No objection
No objection subject to condition on no discharge of surface water to foul drainage
Principle of proposed use not contrary to policy; may enhance appearance of surrounding area
Site zoned light industrial/retail so principle not contrary to policy; unlikely to harm amenity; may enhance area if investment made; accords with BP1, BP10, GP2
Drainage Division offered no objection subject to surface water discharge condition; Patrick Parish Commissioners supported the proposal with suggestions for site improvement; Highways Division confirmed acceptability of parking plan with customer sign requirement; public representation supported as compliant with policy.

Conditions requested: The Commissioners would wish to see a proper and professional forecourt established in order to improve the appearance of the site

SupportThe site is zoned in the Foxdale Plan as light industrial/retail so the principle is not contrary to policy; It is unlikely the proposal will have any detrimental harm to the amenity of the area and if some money is invested in the site it may actually enhance the area; The proposal appears to be accordance with BP1 and BP 10 and, in my opinion, is unlikely to conflict with GP2
