General Policy 2
Requires development to respect surroundings in siting/layout/scale/design (b), not adversely affect landscape/townscape character (c), not harm local residents' amenity or locality character (g), and not unacceptably affect road safety/traffic (i). Officer found proposal fails these due to light spill/glare harming amenity, village character, and potentially road safety via glare.
General Policy 8
Controls advertisements in rural areas, requiring illumination (if essential) kept to minimum, hooded to prevent light escape (g), and no adverse ecological effect (i). Officer applied to lighting, finding lack of cowling causes unacceptable spill in rural context, failing principle test.
Environment Policy 22
Prohibits development causing unacceptable harm via light pollution to environment/nearby amenity. Officer assessed lighting causes light pollution harming amenity and semi-rural setting.
do not oppose; lights away from highway, no spillage onto highway if lighting zone contained within site
no objection; new lighting better than previous floodlights, does not affect property, adds character to building
Patrick Parish Commissioners raised concerns about light nuisance from wall-mounted lights and signage, offering constructive comments on shading, timing, and alternatives rather than a formal objection. Highway Services had no objection provided no light spillage onto the highway.
Key concern: light nuisance and spillage from wall-mounted lights and signage
Patrick Parish Commissioners
No CommentThe following Applications have a consultation period that ends before the Commissioners are next due to meet.; It would be helpful, therefore, if consideration could be deferred until after the end of that week
Patrick Parish Commissioners
Conditional No Objectionmembers have received negative comment from many residents relating to the wall-mounted lights and the size and intensity of the illuminated sign - the latter is described as infusing a blue glow to the village; The Commissioners are keen to encourage the business and offer the following COMMENT which it is hoped will be seen as constructive
Conditions requested: The wall-mounted lights, if viewed as essential, must be shaded or otherwise directed downwards to avoid spillage from the site. Further, they must be timed so as to operate from the premises opening until no later than 7 pm; better lighting might be achieved by an additional one or more columns with lights pointing into the site, again avoiding any spillage. It is suggested that the timing of these lights should mirror the burning regime of streetlights in Foxdale; An alternative to illumination, or in addition, would be the use of Passive Infra-Red for security purposes; The Commissioners are not convinced of the need for the signage to be illuminated. If it is considered so, the degree of illumination must be significantly reduced and should mirror the wall-mounted lights in terms of illumination periods
Highway Services
No ObjectionThe lighting on the building would be located away from the public highway and should not therefore have an adverse highway impact.; Highway Services does not oppose the application.; Recommendation: DNO
Conditions requested: Provided that there would be no spillage of light from the site onto the highway
