The officer assessed whether policy or circumstances had changed since the original approval of PA 17/00214/B, noting the shift from the 1982 Development Plan Order to the Area Plan for the East, but …
Housing Policy 14
Housing Policy 14 governs replacement dwellings, requiring they not be substantially different in siting and size unless changes result in environmental improvement; floor area not more than 50% greater, generally on the existing footprint, with traditional design per Planning Circular 3/91 or high-quality innovative design. The officer found the proposal, previously approved, continues to accord as its size (184% increase but 32 sq m smaller than initial refused scheme), partial footprint overlap, reduced curtilage extension, and setbacks provide acceptable countryside impact despite exceeding 50% threshold, with no policy change tipping the balance.
Environment Policy 1
Protects countryside for its own sake. Assessed as compliant given acceptable resultant impact from the replacement dwelling in this sensitive landscape.
Environment Policy 2
Related to countryside protection. The scheme's visual and environmental effects were deemed acceptable, consistent with prior approval.
Time limit
The development hereby approved shall be begun before the expiration of two years from the date of this decision notice. Reason: To respond to the application as applied for and to avoid the accumulation of unimplemented planning approvals.
Landscaping scheme
All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the construction of the proposed dwelling. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. REASON: the landscaping of the site is an integral part of the scheme and must be implemented as approved.
