The officer noted that following refusal of a prior agricultural storage application lacking justification, the applicant clarified intent for horse stabling, leading to this resubmission.
Environment Policy 1
Protects countryside from development unless overriding national need and no alternative. Officer assessed the stables as justified equestrian use under GP3(f), not detrimental given mitigations, outweighing protection needs.
General Policy 3
Prohibits development outside zoned areas except essential agriculture/forestry including stables. Proposal accepted as 'building and engineering operations essential for agriculture' via equestrian exception, with specific conditions to enforce purpose.
Environment Policy 19
Permits equestrian development if no amenity loss, no Class 1/2 land loss, highways cope. Site not high-quality land, low traffic for adjacent dwelling use, no amenity harm identified.
Environment Policy 21
Stables not permitted if detrimental to countryside character via siting/design/size/finish; must reflect purpose, avoid cavity walls. Building sized for three horses, metal ok if coloured to blend, reflects equestrian function.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Floor plan approval
Prior to the commencement of development, a floor plan showing the internal layout of the building shall be submitted to and approved in writing by Planning and Building Control. The development shall be carried out in accordance with the approved plans. Reason: For the avoidance of any doubt.
Colour coating
Notwithstanding the details submitted with the application the building and roof shall be colour coated either dark green or black and such colour shall be maintained thereafter. Reason: In the interests of visual amenity and to reduce the impact of the building on the countryside.
Use restriction and removal
The building may only be used for the purposes of stabling horses and associated tack room. Should the building no longer be required for its approved purpose, or be vacant for a period of 6 months or longer, then the building shall be removed from site and the land restored to grass. Reason: The building is approved as an exception to policy that restricts unwarranted built development in the countryside.
Do not oppose
Jurby Parish Commissioners commented on the unusual steel-framed design for stables, questioned the private lane status, and recommended no objection conditional on preventing future conversion to agricultural storage or dwelling.
Key concern: steel framed building which is unusual for a stable purpose built building
Jurby Parish Commissioners
Conditional No ObjectionThe proposal is for a steel framed building which is unusual for a stable purpose built building. The usual stable type buildings are timber buildings.; the lane by the side of the property is a private lane, this cannot be, as there are lands beyond the lane which the owners will have access over such private lane.; Should the government planners decide to approve the proposed development, then a condition should be attached that the proposed stables are not to be converted into agricultural storage or a dwelling house or living accommodation at any time in the future.
Conditions requested: a condition should be attached that the proposed stables are not to be converted into agricultural storage or a dwelling house or living accommodation at any time in the future
