The officer determined that a clear agricultural need for the cattle barn had been demonstrated, due to loss of rented land and a previous livestock shed, sufficient to outweigh the general policy aga…
General Policy 2
Requires development to respect site/surroundings in siting, scale, form, design; not adversely affect landscape character, amenity, or habitats. Officer assessed the barn's relation to existing buildings, minimal visual impact from materials and cut/fill into rising ground, and lack of amenity harm as compliant.
General Policy 3
Permits agricultural buildings essential for agriculture outside zoned areas. Officer confirmed the barn's necessity for livestock housing on a large operational farm as meeting the exception under paragraph (f).
Environment Policy 1
Protects countryside unless overriding national need outweighs protection with no alternative. Officer found agricultural need sufficient to justify, with acceptable impact via sympathetic design and siting.
Environment Policy 15
Permits new agricultural buildings where need outweighs countryside policy, sited near existing groups, appropriate scale/materials/siting sympathetic to landscape. Officer noted adjacency to farm complex, matching heights/materials, and care near residences as compliant.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Site levels approval
Prior to the commencement of the development hereby approved, details of the existing and proposed site levels, including existing and proposed section drawings and finished floor levels of the building, shall be submitted to and approved in writing by the Department. Thereafter the development shall be completed in strict accordance with the approved details unless otherwise agreed in writing by the Department. Reason: To ensure the development has an acceptable visual impact upon the landscape and in relation to the excavation and retention of minerals on the site.
Minerals method statement
Prior to the commencement of the development hereby approved, a Method Statement relating to the excavation, storage and re-use of soil and minerals that may be excavated in the carrying out of the approved development, shall be submitted to and approved in writing by the Department. The Method Statement shall include plans identifying where the excavated material will be stored and re-used on the applicant's landholding and the development shall be carried out in accordance with the approved details. Reason: In the interest of retaining materials and minerals on the site.
Agricultural use only
The building must be used only for agricultural purposes. Reason: The countryside is protected from development and an exception is being made on the basis of agricultural need. As such the building must be used for the purposes for which it is approved.
No objection
No significant negative impact upon highway safety, network functionality and/or parking as the site access and internal layout is acceptable for the proposals
No objection, subject to further detailed plans for site levels, cut/fill drawings, method statement for material movement, and consent if minerals are removed
DEFA Energy & Minerals Team raised concerns about site levels, lack of detailed plans, and potential minerals extraction requiring licensing and royalties, recommending submission of further detailed plans and obtaining necessary consents.
Key concern: potential minerals extraction requiring DEFA consent and royalties under Minerals Act 1986
DEFA Energy & Minerals Team
we can not see how the barn can be constructed as shown on the plan without any ground works and changes in the site levels; if any mineral are to be removed from the curtilage of the surface holder's landholding, it is a requirement that you must contact DEFA's Energy & Minerals Team and obtain consent; Depending on the makeup and amount of material the material removed may be subject to a royalty payment
Conditions requested: further detailed plans including cut/fill drawings and method statement for movement of material; contact DEFA Energy & Minerals Team to obtain consent if minerals removed; obtain Mining Permission if applicable
