The original application (PA 01/2047) for erection of a dwelling was refused by the Planning Committee on 10th May 2002 and confirmed on review on 12th July 2002, primarily because the site was suitable for a previously approved shop and there was a demonstrated need for retail facilities serving the Mount Murray estate following closure of the nearest shop. The appellant argued that the prior shop approval had lapsed, no retail interest had materialised, and the proposed house design was acceptable. The Planning Committee and third parties emphasised the estate's growth to 76 dwellings (potentially 175), lack of local retail, and resident expectations for a shop. The inspector found no evidence from appellants demonstrating no need for a shop or its economic feasibility, concluding that granting permission would be premature. The appeal was dismissed.
Precedent Value
This appeal sets precedent that appellants must proactively evidence absence of need for previously approved alternative uses (e.g. retail) on suitable sites within growing estates; future applicants should commission retail need assessments and feasibility studies before appeal.
