Requires new industrial development in Port St Mary harbour to be marine-based, appropriately scaled, sited adjacent to existing uses, not harm residential amenity or leisure/tourist harbour use, and designed/finished to high standard for prominent location. The temporary container represented a minimal departure due to its short-term nature, location next to existing industrial use, and negligible amenity impacts, though not high-standard permanent design.

Permits only development preserving or enhancing Conservation Area character, protecting special features. The existing industrialised harbour form meant the additional temporary container was 'unlikely to impact the character of the proposed conservation area'.
General Policy 2
Permits development in line with Area Plan zoning if it respects site/surroundings (siting, scale, design), avoids harming landscape/townscape character, residential amenity, or public sea views. The proposal complied as the container's siting in the existing yard respected the industrial surroundings without adverse amenity or visual effects.
Time limit
The development hereby approved shall be begun before the expiration of two years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Cessation of use
The use of the container hereby approved shall cease on or before the 31st August 2020, unless otherwise approved in writing by the Department. Reason: The container has been exceptionally approved solely to meet the short term needs of the business and its subsequent retention would result in an unwarranted intrusion to the harbour-side location.
Removal and restoration
The container hereby approved must be removed and land shall be restored to its former condition within 1 month of the cessation of the use, unless otherwise approved in writing by the Department. Reason: The container has been exceptionally approved solely to meet the short term needs of the business and its subsequent retention would result in an unwarranted intrusion to the harbour-side location.
