The officer assessed the proposal against key issues: impact on streetscene character (GP2), visual effect on Laxey Conservation Area (EP35), and light pollution on amenity (EP22).
General Policy 2
Requires developments not to adversely affect landscape/townscape character, wildlife/habitats, residential amenity, locality character, community safety, or energy use. Officer found proposal compliant as uniform lighting improves safety/security without harming character or amenity, using energy-efficient LEDs, and positioned to avoid residential impact.
Environmental Policy 22
Prohibits development causing unacceptable light pollution harming environment or amenity. Assessed via lux modelling (max 5.63 on road), downward design minimising spill/glare, and shields for bats; levels appropriate for semi-rural street, no material adverse impact.
Environment Policy 35
Permits only development preserving/enhancing Conservation Area character. Columns do not preserve/enhance but have 'neutral impact', not adversely affecting character due to heritage design complementary to streetscene and regeneration works.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Bat lighting shields
The external sources of illumination at the brooghs by the coachpark and the river at locations P13 and P14 hereby granted consent shall be installed with Albany external back light shields so as to minimise light spillage in these areas. The means of shielding shall be implemented in accordance with trade literature details submitted on 7th February 2018 to the Department or as otherwise approved by the Department, prior to the means of illumination being first used. Reason: In the interests of the environment and Daubenton's bats recorded in these areas.
no objection
no Highways Involvement in the proposal
no objections to the proposal
DEFA Biodiversity raised concerns about light spillage affecting bats and recommended mitigation via blinds on specific lamps, while DEFA Fisheries, Highways, and Garff Commissioners raised no objections.
Key concern: light spillage affecting Daubenton's bats foraging on waterways
DEFA Biodiversity
Conditional No ObjectionI request that consideration be given, in the siting and light choice, to the avoidance of light spillage into the river at P12 and P13, and into the mill pond at P15; illumination below 1 lumen is less of an issue to light-avoiding bats, and in particular, below about 0.2 lumens; blinds must be fitted to those lamps to prevent lighting of the brooghs and the river
Conditions requested: blinds must be fitted to those lamps to prevent lighting of the brooghs and the river
DEFA Fisheries
No ObjectionDEFA, fisheries have no objections to this development from a fisheries perspective, provided that there is no adverse effect on the adjacent watercourse
