C 1. The site sales board hereby approved shall be for a limited period of 32 months from the date of this approval and shall be removed from site at that time and the site restored to its former state.
Reason: While the site sales board is reasonable, its impact on the character of the area and neighbouring amenities should be minimised by restrict the period of existence only to when the site sales board is necessary. Discussion with the applicant has confirmed that the site sales board would need to be removed once the new residential development start to be occupied, which is expected to be around two years. An extra half years is given as a buffer.
C 2. The illumination should only operate outside of 22:00-6:00.
Reason: in the interest of neighbouring amenities, wildlife protection and preserving the character of the area.
This application has been recommended for approval for the following reason. The proposed advertisement is reasonable for its purpose but it would have a negative impact on its surroundings. However, these impacts can be reduced to a reasonable degree with conditions.

Officer’s Report
1.0 THE SITE 1.1 The site is Bayqueen, the Promenade, Port St. Mary. The site has been approved for a new residential building.
2.0 The PROPOSAL 2.1 The proposed is the installation of an illuminative signage.
2.2 The signage is for the housing development on the site. It is a regular board with projecting lights at the bottom.
3.0 PLANNING HISTORY 3.1 Demolition of registered building and substation and construction of building to provide 23 apartments and cafe/spa/wellness/gym with associated car parking, landscaping and substation (amendments to previously approved PA18/00637/GB and in association with approved 18/00638/CON) and additional use of ground floor apartments as tourist accommodation.
3.2 Installation of a non Illuminated Site Sales Board was APPROVED under PA 22/00786/D. The approved board is at a similar location but is shorter and has no lights.
4.0 PLANNING POLICY Site Specific 4.1 The site is within an area designated as Predominantly Residential in the Area Plan for the South.
4.2 The site is just outside the boarder of the Proposed Conservation Area.
Strategic Policy 4.3 The Isle of Man Strategic Plan 2016 contains the following policies that are considered materially relevant to the assessment of this current planning application: o Strategic Policy 4 (a), 5 o General Policy 2 (b) (c) (g) (i) (m) (n) o General Policy 6 o Environment Policy 36, 38 o Community Policy 7
PPS and NPD 4.4 There is no planning policy statement or national policy directive that are considered materially relevant to this application.
5.0 OTHER MATERIAL CONSIDERATIONS Legislation 5.1 Regulation 5 of the Town and Country Planning (Control of Advertisement) Regulations 2013 states that the control of advertisement is only in the interest of amenity and public safety, in particular general characteristics of the locality, the safety of any person who may use the highway and potential obscuration of any traffic sign or signals.

6.0 REPRESENTATION 6.1 Port St Mary Commissioners has no objection to this application (23.02.2023).
6.2 DoI Highway Services states there is no highway interest in this application (03.03.2023).
7.0 ASSESSMENT Elements of Assessment 7.1 The key considerations in the determination of the application are its impact on the character and appearance of the Area and on the neighbouring amenities.
7.2 The advertisement relates to the sale of the new development on site and is considered to be reasonable. However, the signage does not fit in with the character of the area. Therefore, it is considered that a condition should be attached for the advertisement to be temporary to limit its impact on the character of the area.
7.3 The lights would have impact on neighbouring amenity, wildlife protection and the character of the area. Therefore, it is considered that a condition should be attached to limit the operation hours of the light to minimise these impacts.
8.0 CONCLUSION 8.1 The proposed advertisement is reasonable for its purpose but it would have a negative impact on its surroundings. However, these impacts can be reduced to a reasonable degree with conditions. Therefore, it is recommended for an approval.
9.0 INTERESTED PERSON STATUS 9.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013 (As Amended), the following persons are automatically interested persons: o The applicant, or if there is one, the applicant's agent; o Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; o The local authority in whose district the land which the subject of the application is situated. o the Highways, Ports and Railways divisions of the Department of Infrastructure.
9.2 The decision-maker must determine: o whether any other comments from Government Departments (other than those explicitly listed above) are material; and o whether there are other persons to those listed above who should be given Interested Person Status. __
