The principal issues were the visual impact of the floodlights on the building itself and the wider area, including the adjacent Conservation Area and Registered Building (Old Market Hall RB 120).
General Policy 2
General Policy 2 from the Isle of Man Strategic Plan 2007 is the overarching policy for development proposals. The officer assessed the proposal as acceptable in the Predominantly Shopping Use area of Douglas town centre, given the mixed surrounding uses and minimal visual impact.
Environment Policy 36
Environment Policy 36 requires that development outside but close to a Conservation Area boundary will only be permitted if it does not detrimentally affect important views into and out of the area. The officer tested the floodlights' impact on views to/from the adjacent Douglas (North Quay) Conservation Area, finding no adverse effect due to the site's position next to an unattractive car park (former bus station).
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
