General Policy 2
Requires development in accordance with Area Plans and other policies, without adversely affecting landscape/townscape character (c), amenity of residents/locality (g), providing safe access and parking (h), or road safety/traffic (i). Officer found proposal compliant as no significant adverse impacts on amenity, character, highways, or parking in mixed-use town centre transition zone.
Business Policy 1
Encourages growth of employment opportunities if according with Plan policies. Gaming lounge accepted as it creates employment in acceptable leisure use within transition zone.
Environment Policy 22
Prohibits development unacceptably harming amenity via noise, vibration etc. Assessed as acceptable with noise mitigation (headsets, arcade machines not loud) and conditioned hours.
Transport Policy 7
Requires parking per standards (1 space per 15m2 for assembly/leisure). Officer noted site supports existing high-turnover uses without issues; near alternative parking; DOI no objection.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Operating hours
No customers shall be served or remain in the building outside the following hours: During school term time - 4pm-8pm Wednesday and Thursday, 4pm-10pm Friday, 10am-10pm Saturday, 10am-4pm on Sunday. During school holidays - 10am-8pm Monday -Thursday, 10am-10pm on Friday and Saturday, and 10am-8pm on Sunday. Reason: The application has been assessed on this basis as requested in the application form and in the interest of amenity.
Use restriction
Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 2019, the use hereby approved shall be limited to the proposed leisure and recreational use. Reason: In the interest to protect the character and uses of the neighbouring properties.
Maximum occupancy
The proposed gaming lounge hereby approved shall only support a maximum of 24 Customers (Gamers) at any given time. Reason: For the avoidance of doubt and to ensure the development takes place in accordance with the approved details.
Do not oppose. Site centrally located with walking distance to public transport and other parking; applicant to advise on travel arrangements; parking is amenity issue not highway safety concern; drivers should follow IOM highway code.
