DEFA Planning Committee approved application 22/01340/B for eight townhouses with parking and landscaping on Mixed Use zoned land fronting Mooragh Promenade, subject to a Section 13 affordable housing agreement. Lakeside Apartments residents appealed as third parties, arguing the proposed access through their car park and past garages would harm their amenity, safety, and highway safety contrary to GP2(g)(h)(i)(m). The developer and DEFA defended the access based on Highway Services' no-objection, planning history including larger approved schemes using the same access, and adequate parking/visibility. Inspector Frances Mahoney, after public inquiry and site visit, found no unacceptable highway safety or amenity harm, recommended dismissal with additional conditions for construction management and surfacing markings; Minister concurred on 12 February 2025, upholding approval.
