Proposed Low Density Housing in Parkland
The site is zoned 'Proposed Residential' on Map 6 - Colby/Ballabeg of the Area Plan for the South. The policy requires uses to align with residential designation; officer found dog grooming business unacceptable as it introduces commercial use separated from the main dwelling, conflicting with predominantly residential character despite small scale.
Transport Policy 7
Requires parking provision per Appendix 7 (2 spaces for 2-bed dwelling plus business needs). Officer assessed that available spaces cannot meet residential + operator (non-resident) + client drop-off standards without on-street parking issues; no relaxation justified given site constraints and shared road.
General Policy 2
Sets general development control criteria including amenity, character, parking/access/highway safety. Officer applied even where zoning non-compliant, finding no significant amenity harm but parking/zoning failures overriding.
All new retail development (excepting neighbourhood shops and those instances identified in Business Policy 5) sited within the town and village centr
Directs retail/business to town/village centres. Officer noted no material trade diversion from nearest centres (Port Erin/Port St Mary) for small single-employee operation, but zoning still prevailed.
Business Policy 1
Encourages employment growth island-wide. Officer acknowledged potential for small home businesses to grow and relocate to centres, but applicant not resident owner undermined this rationale.
no significant negative impact upon highway safety, network functionality and /or parking.
Highway Services Division has no objection to the application. Arbory and Rushen Parish Commissioners object due to commercial use in residential zone, parking constraints, and noise from dogs.

Arbory and Rushen Parish Commissioners
ObjectionThe Commissioners were concerned about several matters relating to this application and so agreed to oppose the application.; Firstly, the area to which the application applies does not appear to be zoned for commercial use.; Secondly, the additional parking required for the proposed business would put pressure on the already significantly constrained availability of parking in the area.; Finally, the Commissioners were concerned about the potential for additional noise, in particular dogs barking, associated with the proposed business.
