Business Policy 1
Business Policy 1 encourages the growth of employment opportunities throughout the Island provided proposals accord with the Plan's policies. The officer found the proposal satisfied this by providing for the continuation of employment opportunities through the car hire business employing three part-time drivers.
General Policy 2
General Policy 2 sets out Development Control Considerations. It was listed as relevant but not specifically tested in detail; the overall assessment relied on industrial compatibility.
Business Policy 5
Business Policy 5 states that on land zoned for industrial use, permission will be given only for industrial development or storage and distribution. Storage was deemed acceptable, but car hire (sui generis) represented a minor departure, justified by relation to storage and site suitability.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Permitted uses
The authorised uses of the site are any combination of class 2.2 (Light Industrial and Research & Development), class 2.3 (General Industrial) or class 2.4 (storage or distribution) of the Town and Country Planning (Use Classes) Order 2019 (or the equivalent class in any order that amends or replaces that Order) and also the additional use as an operating centre for car hire. Reason: for the avoidance of doubt and to define the scope of the approval.
Car hire in accordance with details
Any additional use of the site as an operating centre for car hire (as set out in condition 2) shall be in accordance with the approved details including the Planning Statement. Reason: for the avoidance of doubt and to define the scope of the approval.
Storage within building only
No approval is given for the storage of cars or anything else other than within the building, although this does not preclude the use of the outside spaces for staff or customer parking. Reason: for the avoidance of doubt and in the interests of visual amenity.
No significant negative impact upon highway safety, network functionality and /or parking. The Applicant is advised to consider the provision of electric vehicle charging points.
Highway Services HDC and Malew Parish Commissioners both raised no objections to application 22/00231/C, with Highways advising consideration of electric vehicle charging points.
