THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises of a site located on the seaward side pavement of Laxey Promenade. The proposed development comprises of the erection of a street light on the application site. PLANNING HISTORY

Planning application was granted through previous planning application 06/01974/B for the erection of nine street lights along the promenade.

REPRESENTATIONS Laxey Village Commissioners recommend that the planning application be approved. PLANNING POLICY

The application site is designated as open space under the Laxey and Lonan Area Plan Order 2005 and is located within a conservation area. Policy L/CRB/PR/4 of the Laxey and Lonan Area Plan Order 2005 states: "Where an area is designated as a conservation area, special attention must be paid during the consideration of all planning applications within the area, to the desirability of preserving or enhancing its character or appearance in accordance with the Town and Country Planning Act 1991 C12.(4)."

ASSESSMENT

The planning application proposes the installation of a lamppost on Laxey Promenade. The installation of lampposts is normally covered by statutory undertakers permitted development powers meaning that such items can usually be installed without a planning application needing to be made. However, planning permission is required in this instance as the land is within a conservation area and such statutory undertakers powers do not extend into such areas.

The impact of one street light is considered to be suitably limited and given that nine other street lights have already been deemed acceptable it is recommended that the planning application be approved.

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:
