The officer assessed the proposal against Housing Policy 11 of the Isle of Man Strategic Plan 2007, which governs conversions of rural buildings and states that 'Further extension of converted rural b…
Housing Policy 11
Housing Policy 11 permits conversion of rural buildings only if they meet strict criteria including structural intactness, architectural/historic interest, and allows only modest subordinate extensions that do not adversely affect character. It explicitly states 'Further extension of converted rural buildings will not usually be permitted, since this would lead to loss or reduction of the original interest and character.' The officer tested the prominent two storey front projection against this final clause, finding it would substantially alter the barn's appearance despite retention of some original features, failing the policy test.
Environment Policy 1
ENV1 protects countryside (including High Landscape Value areas) from adverse development unless overridden by national need with no alternative. Listed as relevant but not directly applied to refusal, as the key issue was barn character under HP11 rather than broader landscape impact.

The original planning application 08/01246/B for erection of a two storey extension at The Nab Farm was refused by the Planning Committee on 30th October 2008 (decision notice dated 3rd November 2008). Mrs M Baxter, via planning consultant Kaz Ryzner Associates, lodged an appeal on 19th November 2008, which was accepted by the Department of Local Government and the Environment on 20th November 2008 under reference WEST/AP08/0233. The appeal process involved referral to an independent inspector appointed by the Council of Ministers, with a statement of case requested from the planning authority for a potential public inquiry. The council was required to submit their case by 17th December 2008. The appeal was withdrawn by the appellant on 25th February 2010 (notice dated 1st March 2010), so the original refusal decision stands.
Precedent Value
This appeal demonstrates that appellants can withdraw at any stage, preserving the original refusal without inspector determination. Future applicants should consider strategic withdrawal if circumstances change during the lengthy appeal process.
