General Policy 3
Restricts development outside zoned areas except for essential agriculture/forestry operations (exception f). The officer assessed the ménage as essential for private equestrian use associated with the farm, fitting within permitted countryside exceptions despite non-zoned location.
Environment Policy 2
Protects Areas of High Landscape or Coastal Value (AHLV) unless development does not harm character or location is essential. Screening embankments and sunken design ensure 'the development would not harm the character and quality of the landscape' when viewed from highway and footpath.
Environment Policy 19
Permits equestrian activities in countryside if no loss of amenity, high-quality agricultural land (Classes 1-2), or highway issues. Assessed as compliant due to private scale, no land quality loss mentioned, and highways acceptance.
Environment Policy 20
Presumption against large-scale equestrian developments with buildings/arenas in AHLV unless exceptional. Overridden as no buildings/enclosures proposed and visual impact mitigated, distinguishing from 'large scale' policy trigger.
Environment Policy 21
Prohibits animal-related buildings detrimental to countryside character. Not triggered as proposal is open ménage without buildings; design reflects equestrian purpose without inappropriate construction.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Approved plans
This approval relates to the ménage as proposed in the submitted documents and drawings F/1/1 and F/1/2 all received on 25th March 2008.
Private use only
The proposed ménage shall be for private use only and in association with the occupation of Clarum Farm as defined in the submitted plans.
Seeding of slopes
On completion of the proposed works, any exposed slopes are required to be seeded in the earliest seeding season. The type of seed to be planted should be discussed with the Department of Agricultural, Fisheries and Forestry. Any seeding which within 5 years from the completion of the development dies, is removed or becomes seriously damaged or diseased shall be replaced in the next seeding season with the same species unless the planning authority gives written consent to any variation.
