The Site
The application site represents the curtilage of the property "Grovelands" Cannan Avenue Kirk Michael, a bungalow located in the northern corner of the estate. The neighbouring property "Karibou" is located to the north east of the site and due to the arrangement of properties around the corner, the driveways of "Grovelands" and "Karibou" appear combined.
Planning Status
The application site is located within an area identified as being "Predominantly Residential Use" by the Kirk Michael Local Plan. The site is not within the Kirk Michael Conservation Area.
Planning History
There are no previous planning applications considered relevant in the assessment and determination of this application.
Representations
Michael Commissioners indicate no objection to this application. The Department of Transport Drainage Division does not object to this application but attaches a note to any subsequent approval. The Department of Transport Highways Division does not oppose this application. We have received no privately written representations in relation to this planning application.
The Proposal
This application seeks retrospective planning approval for fencing erected along the boundary between "Grovelands" and "Karibou". This consists of timber posts onto which horizontal timber planks have been fixed. The fence runs from the side boundary through to the front of the property at a height of 6ft (approximately 1.8 metres). The fence then steps down to a height of approximately 1.2m.
Assessment
Part of the fencing is of a height that would not be allowed under the provisions of the Permitted Development Order in this location, forward of the building line. In the majority of residential areas, fencing of this height would not normally be acceptable, however the siting of "Grovelands" and "Karibou" is not conducive to affording a reasonable level of amenity to either property as the central site boundary is not well defined. The new fence runs between the garages of the properties and as such is not located close to habitable rooms so as to cause an overbearing impact. It is considered that the fence as proposed is acceptable as it would provide an improved level of privacy to both properties.
Recommendation
It is recommended that the application be approved.

This approval relates to the retention of fencing as shown by the plans and information 2147/1, 2147/2, Letter and Enforcement Photographs x 6 submitted and date stamped 20th November 2007.

Public foul sewerage crosses this site. The Department of Transport Drainage Division will organise for a CCTV survey at the relevant sections to be undertaken. In the event that the survey shows that the Public Sewer has been damaged by the installation, the applicant will be liable to any cost of repair to the public sewer
