The application site represents the curtilage of an outbuilding associated with the property "The Garth", Garth Road Crosby. The building is located to the north east of the main dwelling and was recently the subject of an approved planning application which proposed to refurbish and convert the building including an extension to provide additional living accommodation and a swimming pool. On beginning these approved works it was discovered that the existing building was in a dangerous condition and was subsequently demolished on advice from an independent site engineer. This application proposes to reconstruct the demolished structure.
The application site is located within an area identified as being located outside an area zoned for further development within the 1982 Development Plan Order.
The following previous planning application is considered relevant in the assessment and determination of this application:
Planning application 07/00089/B sought permission to refurbish/convert and extend Garth Flat to provide additional living accommodation and swimming pool. This was approved 15th May 2007.
The Department of Transport Highways Division does not object to this application subject to conditions. Marown Parish Commissioners do not object to this planning application. The Isle of Man Water Authority attaches a note to any subsequent approval. The Manx Electricity Authority attaches a note to any subsequent approval. We have received no privately written representations in relation to this planning application.
This application seeks approval for the reconstruction of an outbuilding to form additional living accommodation with swimming pool extension. As already mentioned, this application proposes to reconstruct an outbuilding which formed part of the approved planning application 07/00089/B. The building would be constructed on the same footprint and would have the same dimensions as the original building. Each elevation would be reconstructed to replicate the original building. Materials from the previous building would be used in the reconstruction with the walls being constructed from traditionally laid stone and the roof being natural slate. On comparing the submitted plans and elevations with the previously submitted drawings of the building, it can be confirmed that the proposed reconstructed building would clearly be an accurate replica of the original building.
The proposed reconstruction of the original building would reinstate the recently demolished structure and would allow the development as approved by Planning Application 07/00089/B to be carried out. As such there would be no additional visual impact created as a result of this proposal than would have resulted from the previously approved application.
It is important to ensure that the building is accurately reconfigured so as to preserve the visual character of the building. From the submitted drawings and information it is clear that this proposal would accurately reconstruct the outbuilding to the same state as has previously been approved.
It is recommended that the application be approved.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the reconstruction of an outbuilding as shown by the plans and information Location Plan, 760.5 Rev 3, 760.6 Rev 2 and 760.7 Rev 2 submitted and date stamped 26th November 2007.
C 3. The roof(s) must be finished in dark natural slate.
C 4. Off street parking shall be provided within the curtilage of the living accommodation in accordance with the Isle of Man Strategic Plan.
An on site turning facility will also be provided within the vicinity of the parking area such that vehicles can turn on site and re-enter the highway in a forward gear.
C 5. The proposed swimming pool shall be for private use only, and ancillary to 'The Garth'.

N 2. There are Underground Cables/Overhead Lines present in the area indicated in the Planning Application.
