Officer’s Report
THE SITE 1.1 The site is the residential curtilage of two new build terraced town houses, "Shore House" and "Boathouse" on Shore Road in Port Erin.
1.2 The existing properties are three storey dwellings. These properties are a floor taller than the two storey terrace to the north of which Shore Cottage is the nearest property, and slightly less tall than Tower View and Frontignac to the south. This property is separated from the boathouse by a 900mm gap.
THE PROPOSAL 2.1 Proposed is the installation of a concrete access ramp to the front of the properties (West Elevation) and the erection of 100mm thick guarding dwarf walls to match that of the height of the neighbouring property (Tower House), finished with concrete copings.
PLANNING HISTORY 3.1 In 2016 Planning Approval was granted for the demolition of existing building and remains of adjoining former boathouse and erection of two residential dwellings with associated integral off street parking and gardens under PA 16/01110/B.
3.2 Planning approval was granted for the development of the boat house for a dwelling, PA 14/01262/B. Tower View and Frontignac were approved under PA 05/01108/B.
PLANNING POLICY 4.1 The site lies within an area designated on the Area Plan for the South (2013) as Residential and within a proposed Conservation Area. The Port Erin Local Plan of 1990 identified Shore Road as an area of interest in terms of local history and architecture.
4.2 The Conservation Area appraisal identifies the following as making particular positive contribution to the Area: ...Cosy Nook Café, Shore Cottage, Surfside, Condor House and Edmund and Margaret Christian cottage, Shore Road and Sycamore, Strand Road - These are all buildings relating to the earlier settlement of Port Erin [Primrose Cottage is also registered]. Although the actual dates of construction for these buildings are unknown, the Edmund and Margaret Christian cottage has a plaque above the front door giving a date of 1781, which may therefore be the date the building was erected. These buildings should be seen a providing a positive contribution to the area as they are the most complete examples of their type in the conservation area.
4.3 The application building is not referred to specifically although the row of buildings is referred to as one of the original parts of the village, centring on its fishing history.
4.4 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
(c) does not affect adversely the character of the surrounding landscape or townscape;
(g) does not affect adversely the amenity of local residents or the character of the locality."

5.2 Port Erin Commissioners have commented "The Board of Port Erin Commissioners considered the above application and resolved to support the proposals." (08.12.2021)
5.3 Department of Infrastructure (DOI) Flood Risk Management Division have commented "Do not oppose" (29.11.2021)
5.4 Department of Infrastructure (DOI) Highways Division have commented "After reviewing this Application, Highway Services HDC finds it to have no significant negative impact upon highway safety, network functionality and /or parking and on the proviso that this proposal is contained entirely within the boundary of the property. The Applicant is advised that Highway Licences may be necessary for use of the highway during construction. - Do not oppose" (09.12.2021)
ASSESSMENT 6.1 The issue here is whether the proposed works would have any adverse impact on the character and appearance of the property which lies within a proposed conservation area. The works will have no impact on vehicular access and parking as these elements are not being changed. In principle the introduction of better accessibility for the property is to be supported.
6.2 The access ramps are both considered to be relatively minor levels of development in this case, each has been designed in materials best matching that part of the house where it is to be located and neither is expected to result in any adverse visual harm to the overall appearance of the dwelling from public view.
CONCLUSION 7.1 The works are considered to accord with General Policy 2 of the Strategic Plan and will not prejudice the designation of the Conservation in Port Erin. The application is therefore supported and recommended for approval.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 4(2) who should be given Interested Person Status. __
I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
