The original application (07/00085/B, resubmission of 06/00182/B) for alterations including a replacement front porch and first floor extension over the garage at Yn Darragh was permitted by the planning authority on 5 March 2007. Neighbour Ms A Knight-Hook (appellant) appealed, arguing loss of light, view, property value, construction damage, parking loss, and personal family circumstances. The planning authority defended that the works were on the far side of the site, hidden by the main dwelling, with no impact on the appellant's property, and garage conversion was not part of the proposal. The inspector found negligible impact on outlook, light, or amenity from Myrtle Cottage, rejected private views as a planning matter, dismissed non-planning concerns like construction damage, and recommended dismissal. The Minister concurred, upholding the approval while expressing sympathy for the appellant's circumstances.
Precedent Value
This appeal confirms that private views over neighbouring land and personal circumstances do not constitute material planning considerations unless creating oppressive living conditions. Neighbours should focus on demonstrable amenity harm like significant loss of light rather than subjective impacts.
