Planning permission has been sought for the following works:

Proposed now is the erection of a garage to the east of the house. The garage is a modest structure, 3m by 7m and finished to match the dwelling (render and slate). There is a new house being constructed alongside whose western boundary is just over 3m from the boundary with this site. There are no windows in the side of the new house which face towards the new garage.
The proposed garage will be built very close to the boundary with the adjacent property. However, a garage of slightly less length could be erected without planning permission under the provisions of the Town and Country Planning (Permitted Development) Order 2005. It is not clear whether such a garage could have windows in it.
The windows will however only serve the garage and the side garden of the new house is not presently private and the windows would not provide a view which is not presently available. If the occupants of the new house could erect a fence which, if it were 2m high would block any view from the garage windows.
There is only 4.7m between the front of the garage and the footway in front of the house. The Town and Country Planning (Permitted Development) Order 2005 requires that there is 5m in order to provide a full length parking space between the garage and the road. There is no other facilities for parking on the site.
Department of Transport acknowledge this in their recommendation not to oppose the application provided that the garage door is a roller or other non-projecting door so that vehicles may get closer to the garage whilst either entering the garage or parking in front of it.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Whilst Manx Electricity Authority represents a statutory authority, the points raised in correspondence relate to servicing and working practices and not planning matters and as such should not be afforded party status in this instance.

R : Reasons for refusal
C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the construction of an attached garage as shown in drawings C105.05-01, -02 and -03 all recieved on 18th August, 2006.
C 3. The external finishes of the extension must match those of the existing building in all respects.
C 4. There must be no discharge of surface water to the main foul sewer.
C 5. The garage door, as installed must be a roller type or other non-projecting and retained as such unless otherwise authorised by the Planning Authority.
N 1. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
