The original application for conversion of a garage/workshop into living accommodation including a rear extension was approved by the Planning Committee on review on 27.10.2006 despite initial concerns. Neighbours Mr and Mrs Mylrea appealed against the approval, raising issues of health/safety from gas flue, noise, disturbance, parking and fire risks. The Planning Committee and applicant argued the revised scheme overcame previous refusal reasons from a 2004 appeal by addressing Conservation Area impacts and providing adequate amenity. The Inspector found the proposal enhanced the Peel Conservation Area, caused no significant harm to residential amenity or highway safety, and recommended dismissing the appeal to uphold the approval subject to conditions including relocating the boiler flue and kitchen vent to the garden side.
Precedent Value
This appeal shows that resubmissions addressing specific previous refusal reasons can succeed even in Conservation Areas, provided objective evidence counters neighbour objections. Future applicants should focus on measurable improvements like layout revisions and compliance assurances rather than relying on prior permissions.
