Please accept this email as an objection to the retrospective planning application in relation to the extraction flue at the rear of the Rising Dragon. The flue is not only an eye sore but is also noisy (it sounds louder than the claimed 30 decibels especially when starting up) and there is odour pollution especially when the air is still or the wind is blowing towards my house. Since the establishment has been closed over the past few months it has made a noticeable difference to my standard of living. I had to live with it all last summer and I can no longer use my sun deck and even leaving the door or window open allows the sound and smell of various foods to enter my house, I am sure if ate there I could tell you what they were cooking.
I was disappointed that they were allowed to keep the previous flue but this is far worse; I do not understand that there is not more protection for the residents of Michael Street given that it is a Conservation Area, there seems to one set of rules for the houses and a different set of rules for the retail buildings. My cottage is the oldest on Michael Street with the deeds going back to 1700 and after viewing maps held at the museum it appeared to be the only cottage for miles so for that reason alone I think it deserves to be better protected.
I understand that the Commissioners do not wish to see empty units but I think any planning applications also need to protect and empathise with the residents. I am sure if the flue was at the front of the building or if it was in their back yard they would have objected.
I understand that some sort of extraction system needs to exist but I do not believe it should affect my life in the way it does and I am concerned that it will devalue my house and also make it difficult to sell. I have lived here since the year 2000 and at this point the Creel, as it was known, was not open and the flue was a passive unit attached to the gable side of their building, higher than the roof line and not in my line of site. I am not sure why for such a small take-away that they need an industrial sized unit.
I believe that if an extraction system is required then it should be fitted flush with their flat roof, as was agreed the last time retrospective planning was sought and I would like the flue exit and motor part of the unit to be in the far corner of the flat roof (i.e. the near right hand side as you look at the building plans that were submitted to the planning office) this would mean that it would be in line with the gable end of my building and furthest point away from my yard, windows and door). Incidentally this is where I thought it was agreed to be the last time planning permission was given. In addition I would also like to see the Kingspan cladding that was added to the outside of the flue ducting in 2006 (much of which still exists connected to the new unit) to be replaced as it has badly weathered and parts regularly end up in my yard.
I hope a quick resolution can be sought and it does not drag on for nearly a year as it did the last time.
