The site represents the curtilage of the Bay Queen Hotel - a Registered Building situated at the northern end of Port St. Mary Promenade.
The site falls within an area designated as Predominantly Tourist Accommodation on the Isle of Man Planning Scheme (Development Plan) Order 1982. On the draft Port St. Mary plan the site is designated as Mixed Use Office/residential.
The site has been the subject of a number of applications including: PA 02/0343 for the erection of two buildings housing 56 apartments (reserved matters from PA 99/2149) approved.
This is an application for Reserved Matters to discharge the Conditions relating to the previous planning application No. 02/0343. Those conditions are 2, 3 and 4 and relating to the phasing of the works, details of the material and construction of the windows and finally details of the balconies and depth of recess of the windows in the front and rear elevations.
With specific regard to Condition 2, the Proposed Phasing Plan (drawing number 327) indicates the sequence of the build. The sequence starts with the building of Block A which is immediately adjacent to the Registered Building annotated as phase 2 and completed with the construction of Block B, the final phase.
The Conservation Officer visited the site in May 2005 and viewed the ongoing works to refurbish the registered building. This work was in line with Condition 2 of the approval. He therefore considers that there is sufficient evidence to satisfy and discharge Condition 2 of application No. 02/0343.
The details supplied within the application in relation to Conditions 3 and 4 of the application are in the opinion of the Conservation Officer, sufficient to satisfy and discharge those conditions. The details give an accurate indication of the depth of reveal to the windows, detailing of the glazing and finishes etc.
The proposal actually proposes amendments to the development previously approved: the top floor has one long unbroken floor with different housing on the top and the ground floor and recessed balconies are subdivided differently. None of this is objectionable.
Fire Prevention Officer recommends consultation with him regarding fire precautions and the Flats Regs.
Manx Electricity Authority recommend discussion with them regarding working practices around the high and low voltage cables which cross the site
Department of Transport Highways and Traffic Division raise no objection to the application.
The above parties represent statutory agencies and should as such be afforded party status in this case.

C 1. This permission relates to the erection of an apartment building with landscaping and parking and the window and balcony details together with access and ventilation all as shown in drawings received on 16th February, 2006.
C 2. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 3. The development must be phased as described in plan reference 327 received on 16th February, 2006.
C 4. The windows and balconies must be installed as shown in drawings reference 322, 323A and 324A all received on 16th February, 2006.
C 5. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
C 6. No apartment may be occupied before the access roads, footpaths and parking areas have been provided to the satisfaction of the planning authority after consultation with the highway authority.
C 7. The existing access for public service vehicles to the rear of the properties to the east of the site shall be retained.
C 8. Notwithstanding the provisions of any Permitted Development Order for the time being in force, the enclosure of balconies is not permitted without prior express planning approval.
N 1. This applicant should consult the Fire Safety Department as the flats must comply with the Housing (Flats) Regulations 1982. It will thereafter have to be registered under the same regulations.
N 2. Prior to the commencement of work the applicant must discuss with the MEA the high and low voltage electricity cables which cross the site.
