In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr D L Jones Proposal: Approval in principle for the erection of a dwelling at: Land Adjacent To Greenlands Gardeners Lane Ramsey Isle Of Man
which was considered on 7 April 2006, for the reasons set out below.

Reasons For Refusal:
- The proposed development is contrary to the land use zoning of the application site, under the Isle of Man Planning Scheme (Ramsey Local Plan) (No. 2) Order 1998, as an area of open space or woodland. As such, the application site is neither zoned for residential development or within a recognised area of predominantly residential use. The residential development of the application site would be contrary to the protection of this area of open space and the overall setting of the adjacent Sulby River.
- The application site is within an area that is known to be prone to flooding. As such, the erection of a dwelling on the site would place the dwelling under an unacceptable risk of flooding and increase the potential for flooding of the surrounding area.
- This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
