Officer's report.
The site represents the curtilage of a residential property which sits on the southern side of Ballafurt Road just to the south west of its junction with St. Mary's Road and on the left hand side of the road to Cregneash and the Sound.
The eastern part of the site (the immediate residential curtilage) lies within an area of "Res" on the Port Erin Plan which was adopted by Tynwald in 1990. The western and longer part of the site is designated as Open Space.
There have been no applications submitted in respect of this site.
Proposed here is the erection of a new garage, conversion of existing garage to living accommodation, upward extension of this part of the building and the replacement of an existing front porch.
The upward extension of the garage will effectively raise the ridge by some 2.5m. This part of the existing house is closest to the road and is in fact immediately alongside it.
The new garage will be 5.8m by 7.3m and 5.2m high. The garage will be 15m or so to the south west of the house. This is located outside the area allocated for residential use on the 1990 Plan and appears to be within an area where there are trees.
The residential curtilage is large and presently accommodates the dwelling together with vehicular turning and parking space. The garage will be built in a pretty wooded area where there is space within the trees, but is generally sloping and where the excavation/groundworks involved in the creation of the foundations and level area for the garage and the proposed turning area would be potentially damaging for the trees and their setting which is not after all designated for development.
The Department of Transport has now indicated that there would be unsatisfactory provision for sightlines from the proposed access. The Society for the Preservation of the Manx Countryside and Environment are concerned that the property has historical association with the renowned painted, William Hoggatt. I have spoken with the Conservation Officer and his assistant, neither of whom seem to think that the property as it stands is worthy of protection nor that the extensions are unacceptable.
There is already an existing garage within the fabric of the building. As such there is no need to provide the new garage other than to provide additional living accommodation for the property. The new garage would be less convenient for those living within the house and would encroach into an area not designated for development and which is attractive and unspoiled and would result in an access which offers inadequate visibility for drivers of vehicles emerging from the site.
Port Erin Commissioner and the Fire Prevention Officer are statutory authorities and as such should be afforded party status in this instance.

The new garage would be less convenient for those living within the house and would encroach into an area not designated for development and which is attractive and unspoiled and would result in an access which offers inadequate visibility for drivers of vehicles emerging from the site. The creation of the garage and the associated turning and access could adversely affect the trees which surround the site of the new building which would be detrimental to the appearance and character of this area which is designated as Open Space on the Port Erin Local Plan.
Note: whilst there is no objection to the proposed alterations and extensions, if the conversion of the existing garage were to lead to a requirement for a new replacement garage, this may not necessarily be acceptable.
