Department Of Local Government And The Environment ### Memorandum TO: Secretary to the Planning Committee FROM: Miss Sarah Corlett, Planning Officer REF: PA 05/00885 – erection of a block of garages to replace builders’ store/yard, old builder’s yard adjacent to 2, Droghadfayle Park, Port Erin DATE: 3rd October, 2005 ### Request For Review The above application was refused by the Planning Committee at its meeting of 24th June, 2005 and notice thereof issued on 30th June, 2005. The agent for the applicant, Dave Luton claims to have requested a review on the same date which the notice was issued which is a little strange as the notice would not have been received by any of the parties until the following day at the earliest. However, such a request was not received by this office within the 21 days appointed for such a purpose. This is not the first time which Mr. Luton has claimed to have sent such a request and where none has been received by this office. There are parties to this application who will have come to the conclusion following the absence of further correspondence after 21st July, 2005, that the matter is not being pursued. As such I would recommend that we do not accept the request for the review at this late stage, particularly as Mr. Luton appears to have requested the review before receiving the notice. If he has done this he is not properly representing his client as he should have read the notice and been aware of the full reasons for refusal before requesting a review.
