C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
C 2. The premises shall only be used as an art studio, including the delivery of education and art exhibitions relating to the art function and for no other use or purpose.
Reason: The premises with the inclusion of this additional use does not fall within any of the Use Classes as specified in the Schedule to Town and Country Planning (Use Classes) Order 2019 (sui generis use) and to clarify the extent of the planning approval.
This application has been recommended for approval for the following reason. The application is considered to accord with General Policy 2, Environment Policies 10 and 13, Business Policies 1 and Transport Policy 7 of the Strategic Plan and the Peel Local Plan of 1989

Officer’s Report
THIS APPLICATION IS REFERRED TO THE PLANNING COMMITTEE AS THE PROPOSED USE COULD BE CONSIDERED CONTRARY TO THE INDUSTRIAL LAND USE DESIGNATION IN THE PEEL LOCAL PLAN
THE SITE 1.1 The whole site is one which has recently been re-developed from a gas works to industrial and office premises with associated parking approved under 14/00930/B and 18/00137/B. The site sits opposite the House of Manannan museum and its associated car park, alongside the same side of the road is the food park and fishyard. Immediately adjacent to the site is a residential property approved under 14/00928/B.
1.2 The industrial building has already had a launderette and laundry use approved under 19/00313/C and a personal training gym approved under 19/00327/C.
1.4 The unit subject to this application was recently approved under 20/01301/C for a change of use to an art/pottery studio.
1.5 The building has a part mezzanine floor internally and 6 car parking spaces.
THE PROPOSAL 2.1 The proposal now is to include an additional use of the existing art/pottery studio to include art exhibitions.
2.2 No external changes are proposed.
PLANNING HISTORY 3.1 Previous applications are referred to in 1.0, most relevant in this case being 20/01301/C for the original approval of the art/pottery studio.
PLANNING POLICY 4.1 The site lies within an area designated on the Peel Local Plan as Predominantly Industrial. Given the nature of the current proposal and minded of the extant approval and already established use of the unit as an arts/pottery studio it would be perhaps best relevant to consider the general standards towards acceptable development listed under General Policy 2, along with consideration to Business Policy 1 in the encouragement of growth of employment, Transport Policy 7 in determining parking and Environment Policies 10 and 13 in determining flood risk impacts.

5.1 Peel Town Commissioners have not commented on the application (01/06/2021).
5.2 Department of Infrastructure Highway Services - Do not oppose (03/08/2021).

5.3 The owner of 6 Oak Road, Peel - in support (09/08/2021) - would enhance the arts community and benefit local culture and economy of Peel and wider IOM and is in keeping with the current use.
ASSESSMENT 6.1 Given the existing and established functions of the art/pottery studio use here it would not be uncommon or out of keeping to have an additional and complementary art exhibition use. It is agreed with the supporting statement that the busiest expected periods would be during any of the opening events where the greatest footfall is likely to cross the threshold of the unit in visiting the exhibition, but minded of the existing parking available at the unit, the adjacent public car parking coupled with on street parking available along the quay and towards Fenella Beach that any additional demand could be easily accommodated and minded of the town centre location would be easily accessible on foot and by public transport links. As outlined in a supporting comment it is also concurred that the proposal will likely have a positive and complimentary effect on the viability and vitality of the town centre and the local arts community. There are no unacceptable or harmful amenity impacts expected on adjacent neighbouring uses and no new flood risk impacts beyond the existing arrangement.
CONCLUSION 7.1 The application is considered to accord with General Policy 2, Environment Policies 10 and 13, Business Policies 1 and Transport Policy 7 of the Strategic Plan and the Peel Local Plan of 1989.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status __
