Officer's Report
The application seeks approval for the relocation of a previously approved summerhouse and decking (04/01141/B) and the erection of fencing in the rear garden of a dwelling in Laxey. The rear garden is steeply sloping and extends up to the Snaefell Mountain Railway line. The application has been submitted following the previously approved development being constructed in a position different to that of the approved drawings.
The occupant of the neighbouring dwelling objects on the grounds that they consider that it will impact on their privacy and want the 6ft section of fence to be extended to the back of the summerhouse. There appears to be an ongoing dispute between the neighbours in respect of what they had agreed in terms of fencing. The applicant has removed the existing hedging in the rear garden and is in the process of replacing this with new hedging. Whilst this will take a number of years to mature when it does it will suitably screen the development. I consider that the applicant proposes sufficient fencing and that the request of the objector is unreasonable. Indeed, I would suggest that the new position actually has less impact on the neighbouring property than the position previously approved.
I recommend that the application be approved.
