In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 21 January 2005, for the reasons set out below.

Reasons For Refusal:
- The structure, by virtue of its height would overlook the rear garden and private space of Number 12 Church Close and would as such be unneighbourly. Even if the side of the frame were panelled, this would not completely remove the opportunity for overlooking. In any case, the frame would still appear above the level of the fence and as such would be unneighbourly.
NOTE As this structure has been refused, it must be dismantled within 4 weeks of this decision as it becomes final.
NOTE This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.

- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.

- The structure, by virtue of its height would overlook the rear garden and private space of Number 12 Church Close and would as such be unneighbourly.
