The structure, by virtue of its height would overlook the rear garden and private space of Number 12 Church Close and would as such be unneighbourly. Even if the side of the frame were panelled, this would not completely remove the opportunity for overlooking. In any case, the frame would still appear above the level of the fence and as such would be unneighbourly. **NOTE** As this structure has been refused, it must be dismantled within 4 weeks of this decision as it becomes final. NOTE This review has been considered by the Planning Committee on written evidence.
