In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby APPROVE the application made by you
Proposal: Erection of ventilation ducting on rear elevation of Duncan's Diner at: 20/22 Michael Street Peel IM5 1HB
Which was considered on 15 October 2004, subject to compliance with the conditions specified below.
Schedule Of Conditions:
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This approval relates to drawing numbers DD1, DD2 and DD3 submitted on 13th July 2004.
- The rating level of the noise emitted from the fan and associated ducting, shall not exceed LAeq, 1 hour - 40 dB daytime (0700 - 2300) and LAeq, 5 minute - 30 dB night time (2300 - 0700) as measured at the façade to the window of any neighbouring residential premises.
- The duct terminal to the kitchen extract system shall be located 1m above the roof as located on plan Drawing DD1 dated 12/07/04 to aid dispersion of odour.
NOTE The rating level shall be measured and calculated in accordance with BS 4142:1997.
This decision was made by the Director of Planning in accordance with powers delegated to him under Paragraph 2 (6) (b) of the Isle of Man Planning Scheme (Development Plan) Order 1982.
Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.
Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
