Discharge Of Condition ### Item For Planning Committee Consideration TO: Secretary of the Planning Committee FROM: Anthony Holmes, Planning Officer DATE: 8th November 2005 Re: PA 04/01202/B – Proposed re-construction of garden wall and re-instatement of approved car parking area, 2 Seafield, Thie My Chree (Rock Cliff), Old Laxey Hill, Laxey. The Planning Committee are requested to consider a submission made in relation to condition no. 3 of the above approved planning application. Condition no. 3 states “The perimeter walling must include troughs in which trailing plants must be introduced to trail down the wall and soften its appearance. This planting must be introduced no later than the first planting season following the completion of the works. Such planting must be the subject of a further plan for approval by the Planning Committee to be submitted no later than six weeks following the date of this notice as it becomes final.” The planning application was approved on the 29th October 2004 with the decision becoming final 21 days later on the 19th November 2004. The submission was not received within the required six weeks and has only now been received following a concerted pursuing of the applicant. I would suggest that it is not the public interest to seek a prosecution is respect of the last submission and the submission should be dealt with. Whilst the quality of the submission is relatively poor I would suggest that the information contained within it is sufficient and that its acceptance would mean that the works would be required to be undertaken in the next available planting season.
