Review Refusal Notice June 2005
Isle of Man Planning Scheme (Development Plan) Order 1982
Warehouse Bar And Grille Ltd The Warehouse Harbour Road Onchan IM3 1BG In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Warehouse Bar And Grille Ltd Proposal: Erection of single storey raised timber constructed at: changing/make-up room off stage within restaurant The Warehouse Harbour Road Onchan IM3 1BG which was considered on 17 June 2005, for the reasons set out below.
Date of Issue: 26 June, 2005 Murray House Mount Havelock Douglas
Reasons For Refusal:
- The changing room, which has already been erected has no provision for noise insulation contained within and has been built partially in front of an existing single-glazed window. As such, noise from the cabaret area can escape and cause nuisance to those properties adjacent to the site and as the cabaret tends to take place in the evenings this is particularly inconvenient for those living alongside.
NOTE As the structure has already been erected and permission has been refused, the structure must be removed within twenty eight days of the date of this notice as it becomes final.
NOTE If a changing facility is required it must be provided with adequate insulation and the advice of a professional noise consultant is strongly recommended.
NOTE This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.
Note 1: The decision contained in this notice does not become final until:
- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.
Note 2: Rights of appeal against the decision of the planning committee are attached.
Note 3: An appeal may be requested within a period of 21 days.
