C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
C 2. Prior to the commencement of the development details of the external finish of the proposed blockwork shall be submitted to and approved in writing by the Department. The detail thereby approved shall be carried out in accordance with that approval.
Reason: In the interests of the visual amenity and the character of the area.

1.0 SITE 1.1 The site is the residential curtilage of an existing dwelling, 19, Fairfield Avenue which sits on the western side of the cul de sac of properties in the close. The dwelling is a semi- detached property with a two-storey extension including a garage and in front is an open, half tarmacked driveway half landscaped grass area which has a dropped kerb over most of the frontage.
2.0 PROPOSAL 2.1 Proposed is the removal of the lower panel of glazing to the large window on the front elevation replaced with blockwork, to the sill of the lower glazing in order to reduce the overall window size.
3.0 PLANNING HISTORY 3.1 There are no previous planning applications in relation to this site.
4.0 PLANNING POLICY 4.1 The proposal site is in an area designated in the Area Plan for the East as Predominantly Residential. 4.2 Given the land use designation, General Policy 2 (in part) of the Isle of Man Strategic Plan 2016 applies "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality."
5.0 REPRESENTATIONS 5.1 DoI Highways Division have commented that there is no highways interest in this application. (11.03.21) 5.2 DoI Flood Risk Management Division have commented that there is no flood risk management interest in this application. (30.03.21)
6.0 ASSESSMENT 6.1 The key considerations in the assessment of this application are the impacts on the appearance of the dwelling, the street scene and the impact on the residential amenity of neighbours. 6.2 Visually, the proposals are relatively minor; the window alteration wouldn't result in a majorly noticeable impact on the appearance of street scene or on the amenity of the residents of Fairfield Avenue. 6.3 The proposed alterations to the size in window, have been implemented on other properties on Fairfield Avenue, the proposal would therefore not be out of keeping with the character of the area. 6.4 It is not considered that any adverse impact would result on neighbour amenity.
7.0 CONCLUSION 7.1 In summary, the proposal complies with General Policy 2 of the Isle of Man Strategic Plan 2016 and is recommended for approval.
8.0 INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;

(c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status. __
