The key issue was whether the replacement windows meet Environment Policy 35 by preserving or enhancing the Conservation Area.
General Policy 2
Requires development to respect site/surroundings in siting, layout, scale, form, design; not adversely affect townscape character or locality amenity. Officer assessed the window replacements as matching existing design/opening, preserving street scene unity without adverse townscape impact.
Environment Policy 35
Permits only development preserving/enhancing Conservation Area character, protecting special features. Front elevation windows tested for visibility/impact; sliding sash method preserves character, but condition ensures external glazing bars to fully meet test.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Window details match existing with external glazing bars
The windows frames, hereby approved, shall match the existing windows in terms of the method of opening and design of the glazing panels, including proportions, but all glazing bars must be expressed externally. Reason: In the avoidance of doubt and in accordance with General Policy 2 and Environmental Policy 35 of The Isle of Man Strategic Plan 2016.
