Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2 and paragraph 8.12.1
The application is a revised submission following a refusal, which was confirmed at appeal in April 2009. The refusal related to a large sloping dormer window to the front elevation of the property.
The previous proposals to the rear of the property were not of any particular concern to the Planning Authority. This current application is proposing minor alterations to the terrace areas that were previously proposed. The alterations do not alter the Planning Authority view on the acceptability of the proposals to the rear of the property.
The key issue here is whether the proposal has overcome the previous reason for refusal for a sloping roof dormer window. The application is not proposing two small hipped roof dormer windows to the front elevation of the property. There is a variety in the nature and form of the properties on Spinney Close and one property has small dormers to the front of the property. This proposal is less

visually intrusive than the previous scheme. It is considered this proposal will not adversely affect the visual amenities of the street scene.
The proposed rooflights into the side elevations of the property will be set approximately 1.7m above the floor level of the study, which will make difficult for the occupiers of the property to overlooking the neighbour properties and will not result in any loss of privacy.
The notes suggested by consultees are not material planning considerations and for that reason are not attached to the report, as part of the recommendation.
I therefore recommend that planning permission be granted subject to conditions.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to alterations, installation of dormers and creation of first floor and ground floor terraces as shown in drawing numbers P01 Rev C, P02 Rev D and P03 Rev A date stamped 12 August 2009.
C 3. No roofing materials shall be used other than materials similar to those used on the existing building.
