The officer noted the application is retrospective but stated that previous case law establishes this neither advantages nor disadvantages the assessment.
Trade Distribution objected to the retrospective fence application due to aesthetics, height discrepancy, and safety issues; Braddan Commissioners and Highways Division had no objections.
Key concern: fence height exceeds application at 3.2m vs 2.54m and health/safety risk from plant pots
Trade Distribution
ObjectionThe fence has been erected by using ply board that has been sign written and attached to a wooden stud frame. The frame work has been left exposed and no effort to cover the framework has been made.; The fence is being used as a frame to support advertising - again this has not been details in the retrospective application.; These are heavy and are beginning to bow due to the weight of the growing plants - this is a health and safety risk
Conditions requested: fence is removed; OR height of the fence is reduced to represent the application; ply board is erected on the back of the fence to make it aesthetically pleasing; plant pots are removed to prevent injury or damage
