Officer’s Report
1.0 THE SITE 1.1 The application site is the curtilage of Court Row Chambers, Court Row, Ramsey. The property is located to the north of Water Street and west of Parliament Square. The existing ground floor of the property is currently used as a restaurant.
2.0 THE PROPOSAL 2.1 The application seeks approval for the change of use of part of restaurant to delicatessen. The hours of operation are proposed to be 10am till 6pm Tuesday to Saturday and 11am to 4pm on Sundays. The shop would be closed on Mondays.
3.0 PLANNING HISTORY 3.1 The previous application is considered to be specifically material in the assessment of the current application:
3.2 13/00787/B - Conversion of ground floor former post office area to a restaurant including the installation of a flue - APPROVED.
3.3 13/01370/D - Erection of illuminated signage and menu board - REFUSED
3.2 There are also various other decisions relating to the site, mostly relating to the previous use as a post office, none of which is considered of direct relevance to the current application.
4.0 DEVELOPMENT PLAN POLICIES 4.1 The application site is within an area zoned as "Mixed Use" as identified on the Ramsey Local Plan 1998. The site is not within the Ramsey Conservation Area. Given the nature of the application it is appropriate to consider General Policy 2 of the Isle of Man Strategic Plan (20th June 2007).
5.0 CONSULTATIONS 5.1 Ramsey Town Commissioners have no objection (received on 23.02.2015) but make the following comments:

"The Applicant has supplied details of opening hours for the proposed delicatessen, the hours being 10.00 am to 6.00 pm Tuesday to Saturday and 11.00 am to 4.00 pm on Sunday.
Should this application be approved, the Commission recommends the inclusion of the above information as a Condition of any such approval."
6.0 ASSESSMENT 6.1 The site is within the Mixed Use part of the Town Centre and therefore the use is considered to be appropriate for this location. The hours of operation are limited to typical working hours, given that the site is within a Mixed Use area this is considered to be acceptable and is unlikely to have an unacceptable impact upon the amenities of local residents.
6.2 Whilst no parking is provided within the site, this is the existing situation. However, it is noted that the current occupants of the building also have off-site parking on a nearby car park. Given the location of the site within the Town Centre it is judged that there would be sufficient customer parking in the area in general and therefore additional car parking is not required as part of the proposal.
7.0 RECOMMENDATION 7.1 In conclusion, for the reasons given the proposal would comply with the relevant planning policies and therefore recommended that the application be approved subject to conditions.
8.0 PARTY STATUS 8.1 In line with Article 6(4) of the Town and Country Planning (Development Procedure)(No2) Order 2013, the following Persons are considered to have sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application: the applicant or, if there is one, the applicant's agent; the owner and occupier of the land the subject of the application; Highway Services, and the Local Authority in whose district the land the subject of the application sits.
