Isle of Man OCMCmilKlU Kelly Lewthwaite Building Design 23 Market Street Douglas IMi 2PA TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE an application by The Fairy Dogmother, Ref 14/01382/B, for the Conversion from storage unit to a dog grooming business, retail related sales and store at Unit 11 Harmat Court Balthane Ballasalla Isle Of Man IM9 2AU subject to compliance with the following condition(s): The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. 1, Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. Retail sales from the premises must remain ancillary to the primary use of the building as a dog grooming business and goods to be sold must be restricted to goods relating to dogs and cats. 2. Reason; To safeguard the amenities of occupiers of adjoining buildings and to maintain the vitality and viability of Castletown Town Centre and other major town centres in the south of the Island. No approval is hereby granted to the erection of signage as such is regulated by the Town and Country Planning (Control of Advertisements) Regulations 2013. An application for Express Consent for the signage should be made under these provisions prior to the erection. 3. Reason: Advertisements are regulated by the Town and Country Planning (Control of Advertisements) Regulations 2013 and require Express Consent. This approval relates to drawing no: WL/14/1332/1, WL/14/1332/2, WL/14/1332/3 and WLyi4/1332/4 all date stamped as received on 3rd December 2014. Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department. This permission refers only to that required under the The Town and Country Planning (Development Procedure}(No 2} Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
