The proposal was assessed against Business Policy 5 and 10 of the Isle of Man Strategic Plan 2007, which restrict retailing in industrial areas unless it meets exceptions and does not harm town centre…
Business Policy 5
Requires on industrial land only industrial/storage/distribution uses, with retailing permitted only if items unsuited to town centres by size/nature or produced on-site, and no detriment to town centre vitality. Officer found retail ancillary and small-scale (3sqm specialist pet goods), not detracting from Castletown vitality, allowing exception despite zoning conflict.
Business Policy 10
Directs retail to town/village centres except neighbourhood shops or Business Policy 5 instances. Assessed alongside Policy 5; dog grooming service and niche sales not mainstream retail, so no significant town centre impact, justifying approval outside centre.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Retail restriction
Retail sales from the premises must remain ancillary to the primary use of the building as a dog grooming business and goods to be sold must be restricted to goods relating to dogs and cats. Reason: To safeguard the amenities of occupiers of adjoining buildings and to maintain the vitality and viability of Castletown Town Centre and other major town centres in the south of the Island.
No signage approval
No approval is hereby granted to the erection of signage as such is regulated by the Town and Country Planning (Control of Advertisements) Regulations 2013. An application for Express Consent for the signage should be made under these provisions prior to the erection. Reason: Advertisements are regulated by the Town and Country Planning (Control of Advertisements) Regulations 2013 and require Express Consent.
