The Inspector assessed the main issue as whether the new windows would preserve or enhance the Conservation Area per Strategic Plan Environment Policy 35 and Planning Circular 1/98.
Environment Policy 35
Requires development within Conservation Areas to preserve or enhance character/appearance and protect special features. Assessed as compliant as proposals preserve area character by matching visible window features. No enhancement but preservation achieved despite uPVC and style issues.
General Policy 2
Mentioned in prior refusal context. Current proposal complies as it avoids prior defects like infill panels, with visible windows matching originals per related Circular guidance.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
No works to decorative cornices
No works are hereby approved or implied in respect of the existing decorative cornices on the application building.
Approved drawings
The windows shall be replaced in accordance with the details shown on drawings 05/34 01; AINGEVILLE/01/02 and /03, and two untitled sheets showing the individual types, all received by the Department on 2nd May 2014.
Proposed replacements match existing window patterns, opening methods and glazing bar sections, including historically accurate sashes to front and sides. Retaining casements at rear and loss of black framing not substantive reasons for refusal.
