PLANNING OFFICER REPORT AND RECOMMENDATIONS Application No.: Applicant: Proposal : Site Address : 14/00543/B Fistard Property Investments Limited Instaiiation of replacement windows to front and rear elevations 11 Station Road Port Erin Isle Of Man IM9 6AE Case Officer: Photo Taken : Site Visit: Expected Decision Level: Officer Delegation Miss Laura Davy Officer's Report 1.0 THE SITE 1.1 The application site is the curtilage of 11 Station Road, Port Erin which is a three storey mid terrace property situated to the northern side of the highway. There is a retail unit at ground floor which has a shop frontage, the upper floors are residential, and these windows are timber sliding sashes. The rear windows are timber sliding sashes with a central glazing bar. 2.0 THE PROPOSAL 2.1 The application seeks approval for the installation of replacement windows in the front and rear elevations. The front windows would be uPVC sliding sashes and the windows in the rear would be uPVC top opening casement windows. 3.0 PLANNING HISTORY 3.1 The following previous planning application is considered to be relevant in the assessment of the application: PA 06/02142/B Installation of a replacement shop front - approved 4.0 DEVELOPMENT PLAN POLICIES 4.1 The application site is within an area zoned as "Mixed Use" identified on The Area Plan for the South 2013. The site is also within the Proposed Port Erin Conservation Area. Given the nature of the application it is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007) and Planning Circular 1/98. 4.2 Environment Policy 35 Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development. 4.3 Planning Circular 1/98 In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows. Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction. 5.0 CONSULTATIONS 5.1 Port Erin Commissioners support the application. 6.0 ASSESSMENT 6.1 The application seeks approval for the installation of replacement windows in the front and rear elevations. The main issues to consider in the assessment of the application are the impacts upon the character and appearance of the property and the street scene in genera!. 6.2 The proposed windows in the front elevation would have the same method of opening as the existing windows and the same glazing sections as the existing windows. 6.3 The rear elevation is not readily visible from the main public thoroughfares and therefore the applicant is proposing to use u PVC top opening casement windows rather than replicate the original sliding sash opening. 6.4 The front elevation is the main contribution to the character and appearance of the property and street scene in general. 6.5 Whilst the area is not a conservation area it is within the proposed conservation area, it is therefore appropriate to consider the impact of the proposal upon this proposed designation. 6.6 It is considered that the proposed scheme would preserve the character and appearance of the property and therefore its contribution to the street scene in general. 6.7 For the above reasons the application is considered to be acceptable and is recommended for approval. 7.0 PARTY STATUS 7.1 The local authority. Port Erin Commissioners are, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered an "interested person" and as such should be afforded interested person status. To comply with article 14 of the Town and Country Planning (Development Reason: Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. This approval relates to Drawing Numbers 1246.1 and 1246.2 date stamped 1st May 2014.
