In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Heritage Homes Ltd, Ref 13/00712/B, for the Erection of a dwelling with detached garage block at Plot 17 Ballanard Woods Ballanard Road Douglas Isle Of Man subject to compliance with the following condition(s):

This decision was made by the Development Control Manager in accordance with the authority delegated to her.
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

The proposed development must not be commenced until either;
Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.

PLANNING POLICY 10. The Douglas Local Plan 1998 zones the site for low density housing in parkland. 11. General Policy 2 of the Isle of Man Strategic Plan 2007 is relevant: 'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption.' 12. Transport Policy 7 of the Isle of Man Strategic Plan 2007 states:
The Department will require that in all new development, parking provision must be in accordance with the Department's current standards.
Principle of development
The effect of the proposal on the character and appearance of the area 17. The proposed dwelling is of a similar size the previously approved scheme, although the house type is quite different. The dwelling would have a traditional Georgian appearance and the design is considered in keeping with the surrounding context and acceptable. Both external material and sun room options are considered acceptable. A small number of trees would need to be removed, none of which are considered to have any significant amenity value. The character and appearance of the area would be preserved.
The effect of the proposal on neighbour amenity 18. The proposed dwelling, by reason of its design and position, raises no significant amenity issues for adjacent neighbours.
Access and parking 19. The access and parking arrangements are considered safe and satisfactory. There is ample parking space for at least two cars. There is no objection from the Highways Division.
Drainage 20. The comments from the WSA are more akin to an informative and their letter has already been copied to the applicant. The detailed drainage arrangements are a matter for the building regulations.
RECOMMENDATION 21. It is recommended that approval is granted.
PARTY STATUS 22. The Local Authority, Douglas Borough Council, is by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d) granted Interested Party Status. 23. The Highways Division is part of the Department of Infrastructure and not an Interested Party. 24. The Isle of Man Water & Sewerage Authority does not raise any significant or relevant planning issues and should not be afforded Interested Party Status.

Recommendation:
C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. The development hereby permitted shall not be carried out except in full accordance with the following plans: Drawing Numbers 2328-P17-01 (site location plan), 2328-P17-02 (block plan), 2328-P17-03, 2328-P17-04 (external material options), 2328-P17-05, 2328-P17-06 (proposed ground floor plans), 2328-P17-07, 2328-P17-08, 2328-P17-09 (proposed elevations), 2328-P1711 (proposed garage block), 2328-P17-12 (landscaping) received on 18 June 2013, and rear and side elevations of garage block received on 11 July 2013.
C 3. All planting shall be carried out in accordance with the approved plans within the first planting and seeding seasons following that first occupation. Any trees or shrubs which within a period of 5 years from the occupation of the development, are removed or becomes seriously damaged or diseased shall be replaced in the next planting season with another of similar size and species, unless the Planning Authority gives written consent to any variation.
