Approved drawings
This approval for the erection of advertising pavement barriers for an outside seating area relates to Drawing No 05B and 06A both date stamped 9th May 2013.
Pavement width
A minimum unobstructed width between the front edge of the pavement café area and the face of the kerb shall be 2.5 metres.
The application sought approval for stainless steel barriers with advertisements around a café seating area on the public pavement in front of 26 Victoria Street, a Registered Building in a Conservation Area. It was referred to the Council of Ministers due to involvement of public highway. The inspector found the barriers compatible with the building's setting, enhancing town centre vibrancy without harming the Conservation Area or highway safety, supported by prior approvals for seating and no objections from the Highway Authority. Policies on Registered Buildings and Conservation Areas were met. The Council of Ministers accepted the recommendation on 12 September 2013, issuing approval on 18 September 2013 with conditions on drawings and minimum pavement width.
Precedent Value
Café barriers on public highway can be approved in town centres if they enhance vitality, leave adequate pavement (2.5m+), and do not harm heritage settings, even for Registered Buildings, provided not physically attached. Future applicants should highlight prior permissions and secure no-objection from highways.
