The initial delegated approval found the proposal acceptable under General Policy 3(f) and Environment Policy 15 as essential for agriculture, supported by DEFA Agricultural Advisor's confirmation of …
General Policy 3
Permits essential agricultural buildings outside zoned areas (exception f). Officer assessed proposal as compliant due to DEFA justification and functional siting near existing group; appeal overturned this.
Environment Policy 15
Requires agricultural need outweighing countryside policy, sited close to building groups, appropriate scale/design sympathetic to landscape. Officer found need sufficient (farm expansion), siting 5m from existing barn acceptable (low eaves 3.353m, olive green cladding), minimal visual impact; 20m separation to neighbour mitigated amenity issues. Appeal found unacceptable.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.

Approved Unanimous
erection of the proposed agricultural barn... has many agricultural attractions to developing and assisting in sustaining this agricultural business (with 80 acres leased on at least 5 year term); comments stand after amended acreage review
No Objection subject to no discharge of surface water to foul drainage
The original application for an agricultural barn was permitted by the Senior Planning Officer on 25 October 2010, supported by the Agricultural Advisor and Lezayre Parish Commissioners. Mr M Bibby, owner of adjacent land with dwelling permission, appealed on grounds of amenity impact, farm justification, noise, health/safety and decommissioning. The applicants defended the need due to farm expansion (35.7 owned acres plus 141 rented), operational requirements and separation distance. The Inspector, following a site visit and written representations, found the principle acceptable under GP3(f) and EP15, no unacceptable visual or amenity harm at 20m separation, and dismissed the appeal on 1 March 2011. The Minister confirmed the approval on 17 March 2011.
Precedent Value
Confirms agricultural need evidence (Advisor report, acreage/lease details) can overcome third-party amenity objections in countryside/AHLV if separation adequate and policy-compliant siting. Future applicants should secure professional ag justification early and quantify distances/impacts.
